House Bill 2447 would have \par\pard\plain\fs16\pard\plain\cf1\f50\fs16\ql affirmed the Commission's authority to take action in disputes involving \par\pard\plain\fs16\pard\plain\cf1\f50\fs16\ql public utilities owned by separate holding companies, but it had drawn heavy \par\pard\plain\fs16\pard\plain\cf1\f50\fs16\ql opposition from DRI, parent of Virginia Power, the state's largest electric \par\pard\plain\fs16\pard\plain\cf1\f50\fs16\ql company. \par\pard\plain\fs16 \par\pard\plain\fs16 \par\pard\plain\fs16 \par\pard\plain\fs16 \par\pard\plain\fs16 \par\pard\plain\fs16\pard\plain\cf1\f50\fs16\ql PAGE 3 \par\pard\plain\fs16 \par\pard\plain\fs16\pard\plain\cf1\f50\fs16\ql Miller dropped the proposal after DRI and Virginia Power asked for an \par\pard\plain\fs16\pard\plain\cf1\f50\fs16\ql order the Commission entered today in a pending investigation of the two \par\pard\plain\fs16\pard\plain\cf1\f50\fs16\ql companies' corporate relationships. The consent decree prevents DRI from \par\pard\plain\fs16\pard\plain\cf1\f50\fs16\ql taking steps such as removing Virginia Power's board members or officers, or \par\pard\plain\fs16\pard\plain\cf1\f50\fs16\ql amending Virginia Power's by-laws, without Commission approval. The order is \par\pard\plain\fs16\pard\plain\cf1\f50\fs16\ql effective until July 2, 1996. \par\pard\plain\fs16 \par\pard\plain\fs16\pard\plain\cf1\f50\fs16\ql In a statement, Miller said: "The Commission needs the authority which my \par\pard\plain\fs16\pard\plain\cf1\f50\fs16\ql bill would have provided. Though it was prompted by the recent dispute \par\pard\plain\fs16\pard\plain\cf1\f50\fs16\ql between Dominion Resources and Virginia Power, the potential problems it \par\pard\plain\fs16\pard\plain\cf1\f50\fs16\ql addressed are certainly not unique to those two companies. I think \par\pard\plain\fs16\pard\plain\cf1\f50\fs16\ql legislation like this will still be necessary sooner or later. After \par\pard\plain\fs16\pard\plain\cf1\f50\fs16\ql reviewing today's order from the Commission, I congratulate these companies \par\pard\plain\fs16\pard\plain\cf1\f50\fs16\ql for voluntarily accepting these conditions. If they can't find a long term \par\pard\plain\fs16\pard\plain\cf1\f50\fs16\ql solution to their problems while these rules are in effect, there will be time \par\pard\plain\fs16\pard\plain\cf1\f50\fs16\ql for legislation to be enacted at the next General Assembly, and that law will \par\pard\plain\fs16\pard\plain\cf1\f50\fs16\ql become effective before the order expires in July, 1996. Baucom said: "I believe \par\pard\plain\fs16\pard\plain\cf1\f50\fs16\ql today's Commission order, which has a limited life, is a better solution to a \par\pard\plain\fs16\pard\plain\cf1\f50\fs16\ql temporary problem than putting a new law on the books, and that is why \par\pard\plain\fs16\pard\plain\cf1\f50\fs16\ql Dominion agreed to these restrictions.
